No PREJUDICE Act

This bill aims to prevent the Department of Homeland Security (DHS) from using federal funds for discriminatory profiling. It explicitly prohibits DHS officers or those acting under DHS authority from seizing, detaining, arresting, or subjecting individuals to investigatory activities based on their actual or perceived race, color, religion, sex, national origin, gender, gender identity, sexual orientation, or ethnicity.

The prohibition also extends to profiling based on an individual's presence at locations associated with informal employment, participation in specific hobbies or jobs, or the use of Spanish, any non-English language, or English with an accent. Furthermore, the bill establishes a mechanism for aliens in removal proceedings to request a hearing in a U.S. district court to determine if this prohibition was violated. If the court finds a violation, the removal proceedings against the alien must be dismissed.
