The resolution defines a "confirmed positive result" as one that undergoes an initial positive test, is confirmed by a second test using a different chemical process, and is certified by a medical review officer, specifically excluding legal or prescribed medications. Upon a confirmed positive result, the information would be provided to the Member involved and to the relevant ethics committee (House Ethics Committee or Senate Select Committee on Ethics) for necessary review. Importantly, if a Member refuses to participate in the program, their identity will be publicly disclosed by the respective ethics committee, which may also take other appropriate action. Additionally, each Member is responsible for reimbursing the House or Senate for the cost of their individual random drug test.
